Telecom Industry Sues NY Over Law Requiring Low-Cost Broadband for Some Customers

An Association representing Telecom and Wirless Providers such as, AT&T and Verizon, is Suing New York over a New Llaw requiring Internet Service Providers (ISP) offer Discounted Rates to Low-Income New Yorkers.

New York State "overstepped its regulatory authority" when Gov. Andrew Cuomo (D) signed a Bill earlier this month Requiring ISPs to Charge Qualifying Families No More than $15 per month, according to a Lawsuit filed Friday, in Brooklyn federal Court.

The Lawsuit—filed against Attorney General, Letitia James (D), is led by the New York State Telecommunication Association and the CTIA, a National Lobbying Group for Wireless and Broadband Providers.

The Group is asking the Court to find New York's Law in Violation of Federal Statutes that the Telecom Industry says Prohibits Rate Regulation.

In Signing the Bill, on April 16th, Cuomo said New York would be the First State to Guarantee Affordable Internet.

About 2.7 Million Households Statewide will Qualify for the Plan, he said.

The Bill Passed by the State Legislature caps a BasicBbroadband Plan at $15 per month and a Higher-Speed at $20. Currently, a Basic High-Speed Plan costs, on average, more than $50 a month.
