Updated R&D Tax Incentive guidance published on ATO Website

Updates to the R&D Tax Incentive content on the ATO website have now been made and it’s noted on the main R&D Tax Incentive section of the ATO website that content was  ‘Last modified: 22 Nov 2022’.

The main updates appear to be in relation to the changes to the R&D Tax offset calculations commencing July 2021 for the FY22 period (including clawback adjustments), and this content complements the FY22 R&D Tax Incentive Schedule Instructions originally published in June 2022.

The main ATO R&D Tax Incentive guidance document titled ‘Amounts you can claim’ has also been updated with a last modified date of 22 Nov 2022, however again, the changes appear to be mainly in respect of the R&D Tax Offset calculations (including clawback adjustments), and there do not appear to be material changes to guidance on the nature of expenditure that is eligible or the relevant record keeping requirements.

Some of the older ATO R&D Tax Incentive guidance documents are still available on the website if specifically searched for, including the below publications:

  • Keeping records and calculating your notional deductions – Last modified: 28 Feb 2017;
  • Prior year Clawback Adjustment Guide – Last modified: 13 Apr 2021;

Stakeholders should ensure that they are up to date with the latest guidance if participating in the programme.
