Why do People Decide to make a Claim for Compensation?

At GC Law we’ve been handling Compensation claims for years. Out of all of the people we’ve helped, there has been no one who has actually relished the opportunity to make a claim for compensation.

In fact often it’s the opposite. Some people think claiming compensation is a grab for cash or that they might be claiming some kind of unfair advantage. Some people think it’s just un-Australian to claim compensation. But at the end of the day, there are a few common reasons why people decide to claim compensation after an Injury.

Loss of Wages.
If you’ve had to take time off work because of an injury, you either lose wages or take leave you wouldn’t otherwise have taken.

It’s one thing to have suffered an injury, but another to lose wages or to have to take leave that was previously set aside for the family holiday. This can be enough to prompt some people into making a claim.

Your Employer Doesn’t Care.
This is particularly relevant to injuries that occur in the workplace. Some employers show no compassion at all, make no enquires about your wellbeing and may even alienate you after you’re injured. Instead of being the hard working loyal employee, you’ve become a liability. This change in perception will often drive an injured worker to make a claim for compensation.

Your injury Was caused by Gross Negligence.
A person’s perception of the degree of carelessness of the person at fault can make a difference when a person is deciding to make a compensation claim. When someone does something that is absolutely beyond belief that results in an injury to someone else it can be motivation enough for somebody to make a claim.

A Desire To Prevent An Accident Happening To Somebody Else.
Often the outcome of a successful compensation claim will bring a change in practice and procedures to make things safer. This means the likelihood of the accident occurring again can be reduced or even become impossible. Improvement in safety is often a driving factor for people when deciding to claim.
