A Steep Rise in the Trademark Registration and Trademark Renewal government fees has been proposed by the Ministry of Commerce and Industry, Government of India.
Trademark Registration Fees to be hiked from Rs 4,000/- to Rs 8,000/–
Trademark Renewal Fees to be hiked from Rs 5,000/- to Rs 10,000/–
Trademark Restoration Fees to be hiked from Rs 5,000/- to Rs 10,000/-
All the government fees for applications relating to Trademark shall be doubled as per the above structure.
Previously, in the month of August, The Ministry had increased the Government Fees of Trademark Registration in India from Rs 3,500/- to the current Rs 4,000/- without giving any prior notice. Also, they had implemented it on 6th of August 2014, and had applied it to all the applications filed from the 1st of August 2014. We had to request all the clients whose applications we had filed between 1st August and 6th August, to deposit extra Rs 500/-.
Public Notice for the above mentioned price hike – PUBLIC NOTICE
It is noteworthy that the ministry does not inform well in advance before increasing the prices, and given the fact that the number of applications made has increased drastically over the recent years, it is bound to increase the prices anytime soon. According to an RTI application, 2,06,000 applications were filed for Trademark Registration from January 1st to August 31st, 2014. The number for the corresponding period in 2015 was 1,64,000. Thus there is a heavy load on the trademark office to issue examination reports on each of the applications, and as per the RTI there are on an average of 24 examiners. Thus the number of examination reports to be issued for the applications filed from January 1st to August 31st, 2014 is 59 per examiner per day, considering 260 working days. This will immensely hamper the quality of examination reports issued by each examiner on each application. This fact favours the rise in prices, and hence the decision is inevitable.
The good news here is that they have released a proposed draft Trademark Amendment Rules, 2015, for public opinion. Hence the following news was published in The Times of India regarding the same. Please find the following Times of India News link for your reference.
