Landlord Law Blog looks back at 2017

Merry ChristmasWe generally take a long break over Christmas – to allow Ben and I a bit of a break, and this year to allow my injured finger time to recover its full typing capacity.

Although mind you I will still be working – one of my projects is our January Promotion.  Which will be a bumper collection of tips for navigating 2018, free giveaways and special promotions.

The EarthJanuary

We started the new year with a review of what was in the pipeline for 2017 – some of which have still not yet come to pass.

I started a long series on tenancy agreements which went on until late August.  You can read all the posts from the index on the pages.

I did a post on the perils of not serving documents properly, and Ben warns landlords about the perils of taking over a tenancy and section 3.

Blog clinic posts included posts on whether a landlord can accept rent after the tenant has left and whether a landlord forfeits the deposit if he lets a tenant leave early.

February

In February (a short month) we announce a new Lodger Landlord website, and I take a look at the top five mistakes made in possession proceedings and how to avoid them.

We announce the venue for our 2017 Conference – which turned out to be so good that we are going back there for 2018!

Blog clinic posts included this one about an appalling HMO landlord, whether a clause requiring tenants to pay Council Ta is unfair, and the status of a tenancy granted by an unauthorised person.

March

I visit the ARLA Conference and see Robert Peston and William Hague.

I do information posts on what happens when possession proceedings go wrong, consider whether Property Redress Schemes are useless (they are not) and wonder why some Judges are so picky about possession proceedings.

Ben writes an open letter to the PM about benefit and the under 22’s and does a piece on Rent Repayment Orders,

I introduce our free insurance e-course and write a guide to unlawful and lawful discrimination.

I take a look at some complicated questions and issues concerning letting agent fees to tenants, and discuss new rules on Local Authority enforcement,

I also whether modular housing can solve the housing crisis.

Blog clinic posts include a post on service of documents on tenants abroad, whether letting agents can refuse to provide a landlord’s address to their tenants and tenants rights if their car parking space is blocked.

May

I consider problems with Freehold and Leasehold insurance, and look at prescribed information and the terms of the tenancy agreement

We publish a video interview with Sean Hooker of the Property Redress Scheme and also an interview with barrister Robert Brown.

The Grenfell Tower Block on fireJune

I look at what you should do if you agree to let your tenants run a home business from your property and Ben considers scams and trends of holiday lets.

David Smith does a guest post on whether the HMO regulations apply to joint tenants.

Grenfell happens and Ben writes about it in his Newsround and then discusses the reality of re-housing the tenants locally.  I wonder if it is a monument to the death of the ethos of public service.

I report on the First North Staffordshire Landlords Conference where I was the headline speaker.

Blog clinic posts include posts on whether deductions can be made from the deposit if the repairs were never done and what happens if a purchaser finds tenants in the house he buys at completion.

HouseJuly

Ben asks what you really know about rogue landlords, tells the startling story of tenants who dare not ask for rent receipts, and asks if licensing really does any good.

I publish my response to the tenant fee ban consultation and take a look at modular housing.

Blog clinic posts include posts on whether tenants can withhold rent due to the poor condition of their property and whether a tenant has to sign a new tenancy when they may have to move out at short notice.

Should Law and Justice be Free?August

I announce that as of August 1 Landlord Law will be run through the Easy Law training company (now renamed Landlord Law Services Ld), although this blog will remain in my own ownership.

I start a new series ‘should law and justice be free‘ about legal costs, warn letting agents that they can be prosecuted for giving sham licenses to tenants and wonder whether long fixed terms should be made mandatory.

Ben looks at the club member scam.

Blog clinic posts include posts on whether break clauses are compulsory in tenancy agreements, whether a landlord can include a clause preventing a periodic tenancy after the fixed term,  and consider how long possession proceedings will take if landlords urgently need the property themselves.

We have a guest article by Robert Mullarkey of Anthony Gold on Rent Repayment Orders and Ben has a warning about fire safety in micro units.

I give a warning to landlords looking to run their properties through a limited company.

Blog clinic posts include posts on whether a tenant must get rid of her dog when she was previously told it was allowed, dealing with property repairs when the agent refuses to act and how to deal with neighbours who are constantly complaining about the noise.

Fighting the Housing CrisisOctober

I report on a new case involving agents fees, Foxtons and tenancy administration charges, feedback on a conversation with the DCLG, and consider poor letting agent practices which justify dismissal.

I introduce a new series on fighting the housing crisis and explain the new Energy Efficiency Minimum standards rules.

Ben looks at how you can protect tenants whose landlords face mortgage repossession proceedings, what homelessness units say to tenants, the emerging trend of meter tampering and the state of our county courts.

Blog clinic posts include posts with suggestions for a tenant who has received an eviction notice and whether a tenant has to pay for damage if the landlord did not ask for a deposit.

We have a guest post from David Smith on the Letting Agent Fee Ban bill.

Ben shines a light on intentional homelessness, looks at implied surrender and its case law and does his 300th and final Newsround.  It’s up to me from now on.

I discuss six serious mistakes made by landlords when renting to tenants.

Blog clinic posts include posts on how to evict a relative who was allowed in without paperwork, whether shift workers can require their landlords not to ring during the day and what the situation is regarding remaining tenants if one of them moves out.

In a shorter than usual month of posts, I discuss using the landlord tap website to prevent unpaid water bills and Ben considers Banning Order Offences, and the Rogue Landlord Database, and Interim anf Final Management Orders.

The only Blog clinic post is on whether service of an abandonment notice allows you to change the locks.

So that’s 2017 on the blog.
