I never thought traditional Testimony for my Intellectual Property Expert witness cases in footwear and accessories could take on a whole new meaning or, even, a new venue. During these unprecedented times and following “shelter in place” requirements, we are all provided with opportunities to offer flexibility and create new ways of working with brands and clients.

Luckily, we have options. Just one example, according to Law360, is the Federal Circuit airing of live audio of oral arguments due to extraordinary circumstances.

Another is remote depositions becoming the norm moving forward. We are still able to hear the testimony as well as see the witnesses and attorneys. Now, and in the future, we can enhance and move litigation forward, conduct discovery and meet critical deadlines using live video and audio recordings from the comfort of our home offices, expert’s homes and an attorney’s chosen Office space.

Preparation and testing prior to getting started is key. Personally, I am thrilled to offer this service, work through possible scenarios and see it expanding even after we get out of the house and back in the office. Imagine the time and cost savings for brands and individuals.

It is important for experts and attorneys to work together and help brands get their cases resolved. Many cases could benefit from live video and recording during a time when we are working from home and have technology such as Zoom, Docusign, Dropbox and more readily available.

As an expert who has testified (Markman Hearing, Deposition and Federal Court Trials) on multiple footwear cases over the past 8 years, I know we can participate from our home offices while maintaining the same level of preparation and professionalism as we do in person at attorney’s offices or in the courtroom. We don’t have to be in the same place to move Intellectual Property cases forward. It is a win for all those involved.
