Court To Kashamu On Fear Of Extradition: Execute Two Previous Judgements You Obtained
Justice Okon Abang of a Federal High Court in Abuja on Thursday told Senator Buruji Kashamu to go ahead and execute the two previous judgements he got from the court stopping the Federal Government from forcibly transporting him to the United States of America to face trial for alleged fraud.
Kashamu had approached the court for an order to prohibit the police and the Department of State Security Services from arresting and transporting him to the United States to answer charges on drug relates offences.
However, the court told him to go ahead and execute the judgements he earlier got in his favour.
The judge, who ruled on the submissions of the police and one Hon. Oladipupo Adebutu, held that if Kashamu was sure that the police and the DSS were taking steps to arrest and extradite him to the United States, he should execute the two earlier judgments obtained against the Federal Government.
Abang said it was not necessary for the Federal High Court to issue a fresh order against the defendants in the matter since the same court had delivered two judgments in his favour on the subject matter.
In his motion on notice filed by his counsel, Godswill Mrakpor, the senator claimed that unless the court grants him the injunctive order, his security would be put in jeopardy by security operatives.
On the petition against Kashamu by Adebutu that Kashamu was threatening his life, the judge ordered that status quo be maintained in the matter pending the determination of the motion on notice filed by the senator.
Abang said his decision was based on the consent of the parties that they shall suspend action on life issue as it was before the court.
The judge, however, referred the case filed to the Chief Judge of the court, Justice Ibrahim Auta, for reassignment to another judge after vacation.
He said his tenure as a vacation judge would end on September 9 and that he could not afford to open a fresh case he would not be able to complete.
