The Delhi High Court on Wednesday issued notice in a plea seeking directions to establish a Consumer Dispute Redressal Commission in Shahdara district in view of the fact that there is no Consumer Redressal Forum.

A bench headed by Chief Justice D.N. Patel, Justice Jyoti Singh sought the response of the Delhi Government on the plea and listed the matter for hearing on March 26.

The petition has been filed by a social worker Rakesh through Advocates Arvind Kumar Dubey, Vidya Sagar and Pawan Kumar. The petitioner submitted that at present there are 11 districts in the National Capital Territory of Delhi i.e. (1) New Delhi, (2) Central District, (3) East Delhi, (4) North Delhi, (5) North-East Delhi, (6) North-West Delhi, (7) Shahdara, (8) South Delhi, (9) South-East Delhi, (10) South-West Delhi, and (11) West Delhi. 

The petitioner has further contended that there are only 10 Consumer Disputes Redressal Commission in the Delhi and it is requirement of the law that there ought to be 11 districts for ‘Consumer forum’ as per the District wise scheme, for proper administration of Justice in matters related to consumer disputes. 

The petitioner has submitted that as per the districts system, at present, there are 11 District Courts in Delhi as each District is headed by District and Session Judge as now the Judiciary is also working in the 11 districts and the Administrative Work has been divided in 11 districts, each district is headed by District Magistrate as now the Administration has been working in separate 11 districts. 

For proper Redressal of Consumer disputes in the new District Shahdara, there is a need for one “Consumer Disputes Redressal Commission” in Shahdara for reducing the work load of the East District and North-East District, said the plea. 

The petitioner has also cited it as the main reason behind the slow disposal of Consumer related matter in the two districts cited above and submitted that there is a urgent need for creation of a ‘Consumer forum’ in ‘Shahdara’ District. “Early disposal of the case is the legal right of the each and every person, who is litigant and suffering from the Consumer Dispute and it is moto of the act to disposed of the matter as early as possible,” said the plea.
