After 64 parliamentary MPs signed an Impeachment motion against the Chief Justice of India, Dipak Misra – VP Venkaiah Naidu had put the consultations on the Notice of removal of the CJI in motion and today, he rejected the notice issued by Opposition ministers.
Vice President and Chairman of the Rajya Sabha – M Venkaiah Naidu had set in motion, a consultation on the notice of removal against Chief Justice of India Dipak Misra, amid indications that he will not take long to decide whether the notice is admissible at all and merits an enquiry. The consultation process has begun days after seven Opposition parties, led by the Congress, sent a notice for the impeachment of Chief Justice of India Dipak Misra with charges of “misbehaviour and incapacity”. Naidu has already had discussions with constitutional and legal experts regarding the impeachment case.
As the latest development in the case, today, Vice-President Venkaiah Naidu rejected the CJI impeachment notice saying it lacked ‘substantial merit’. Naidu said, “Having considered the material contained in the notice of motion and reflected upon the inputs received in my interaction with legal luminaries and constitutional experts, I am of the firm opinion that the notice of the motion does not deserve to be admitted. Accordingly I refuse to admit notice of motion.” The rejection by the VP was warmly welcome by PM Modi who called the rejection of the impeachment motion to be a victory of democracy.
However, Opposition leaders have immediately reacted against the rejection and said expressed that a notice bearing signatures of 64 MPs and seven former MPs cannot simply be rejected by the Vice President. The progress in CJI impeachment is closely watched by the people of India as it is the first time in the constitutional history of India that a judge of the apex court has been noticed with impeachment motion. This is considered to be the worst crisis in the constitutional history that the Supreme Court has seen since the 1975 emergency.
