An application for interim relief on the draining act

summary proceedings of, among other things, Privacy First and Bits of Freedom against parts of the Intelligence and Security Services Act only take place after the introduction of that Act on 1 May. That says one of the lawyers involved against Tweakers.

Initially, the organizations wanted the summary proceedings to take place before May 1, but that turned out not to be possible. The organizations that prepare the summary proceedings had to wait for publication of the policy rules with amendments to the Wiv. They came online on Thursday .

The summary proceedings will now take place after the introduction of the Wiv. When that will be, is still unknown. “We are still collecting and formulating our arguments”, says Jelle Klaas of the organization Pilp against Tweakers. “There are many organizations involved and everyone wants to submit arguments, I think we will have a chance in a lawsuit, even if it is not a cat in the cup.”

The lawsuit comes from various organizations, including Privacy First, Bits of Freedom and the Dutch Association of Criminal Lawyers. They believe that the Wiv violates privacy on a large scale and therefore they want the court to put the law out of action.
