How To Legally Obtain CBD Oil In Georgia

In April of 2015, Governor Nathan Deal signed Haleigh’s Hope Act (House Bill 1 or HB1) into law in Georgia. HB1 allows for individuals to legally possess cannabis oil.  There are restrictions, most importantly you have to be diagnosed with specific medical conditions by a physician and register with the State Department of Health’s Oil Registry.

Medical Conditions Covered Under HB1

  • Cancer
  • Amyotrophic Lateral Sclerosis (ALS)
  • Seizure disorders
  • Multiple Sclerosis
  • Crohn’s Disease
  • Mitochondrial Disease
  • Parkinson’s Disease
  • Sickle Cell Disease

Conditions added under House Bill 65 (HB65) in 2017

  • AIDS
  • Alzheimer’s Disease
  • Autism,
  • Epidermolysis Bullosa
  • Peripheral Neuropathy
  • Tourette’s Syndrome

There is also a provision within HB65 to allow patients in hospice care to possess the oil without fear of prosecution.

How To Legally Obtain CBD Oil In Georgia

  1. Be diagnosed with one of the medical conditions listed above by a physician.
  2. Pay $25 and register with the Georgia Department of Health Low THC Oil Registry.
  3. Oil must be in a pharmaceutical container, and must clearly state the percentages of THC and CBD contained.
  4. The oil cannot contain more than 5% THC with at least the same amount of CBD.
  5. A patient cannot possess more than 20 ounces of oil at a time.

Other HB1 Advantages

When signed into law, HB1 immediately provided immunity and protection from prosecution for possession of cannabis oil with less than 5% THC.  Many families had to move under previous laws in fear of being prosecuted for doing the one thing that provided relief to loved ones.  Since cannabis is a schedule 1 narcotic, possession of any part of the plant was punishable by law.  Not only was possession a problem, but finding a source of an illegal product was hard to do as well.

Problems with HB1

The bill did NOT legalize cannabis for any medical purposes outside of eight specific, qualified conditions.  It also did not legalize cannabis for any recreational activities. Medical Cbd Oil can only taken in oral form, smoking is not currently allowed under HB1.

The biggest obstacle faced under the bill is that it does not provide a way to gain access to the cannabis oil in Georgia. Families become desperate to fend for themselves and incur financial problems traveling to other states just to get their medicine.  They are breaking federal law in the process by crossing state lines with CBD oil and are subject to prosecution if caught.

Future of CBD in Georgia

HB1 was a start in the right direction, but does leave some work to do.  Accessibility or cultivation needs to be addressed to make CBD oil more available within the state.  Families should not be in fear of getting medical care for loved ones in already trying times due to CBD not being available within the state.

Even though HB65 add more conditions that are covered covered, there are still a large number of suffering patients that are excluded. The list of qualifying conditions should be based on research and doctor’s certification, not legislators’ opinions about which conditions are severe enough to have access to medication.   HB 65 also added a provision for patients in hospice care to be able to possess CBD oil.

70% of Georgia citizens support an in-state cultivation model, so legislators responsible for making our laws need to be reminded that they are going against the will of the majority of our citizens if they don’t support this effort going forward.
