Migrating to Germany

The immigration to Germany was started in 1960 due to shortage of labor during the Wirtschaftswunder (Economic miracle). Those foreigners who migrated to Germany and settled over here during that decade were called as “Gastarbeiter”. These were temporary migrants on work permit, but many of them stayed permanently over here, out of which few became citizens and few of them got asylum.


A new Immigration law was passed in 2005 and today Germany has become one of the most popular immigration destinations in Europe


Approximately 8% of total German population today is foreigner. This group of foreigners is quiet heterogeneous as all of them belong to different origin and Hold different profession, employment rate and duration of stay. Based on the nationality a foreigner holds, they are distinguished into three groups by the German law leading to very different legal positions.


Germany holds the largest economy in Europe and it is most rapidly growing country in the field of Information Technology, automobiles, scientific researches and medicine. Therefore the scope for the skilled professionals and workers from different countries has increased in last few years. The visa status is categorized as:  
 

a) Settlement Permit – The people holds citizenship of the country and gets the benefits

of all legal government benefits.

b) Residence Permits – It is for temporary stay in Germany given for the purpose of

Education or training, Research, productive Employment, International-law,

humanitarian, political or family reasons.


The highly qualified employees under the Labor migration visa are granted permanent residence from the outset. They get settlement permit very soon and can also bring their family with them.


There exist rule for equality in all companies and corporate sectors. The Betriebsrat (Works council in Germany) makes sure that the foreign workers are not discriminated on the basis of their race, religion, nationality, origin or political affiliation and all are given equal rights. In the Betriebsrat elections, all adult employees of the company are eligible to vote, Citizenship does not matter. Betriebsrat cater to ensure compliance with laws and collective agreements.
