The Samajwadi Party fued, which had started in the last year, is expected to continue little more, even after the party split into two factions.
The Mulayam Singh Yadav claims that the party is united, because the January 1 national convention, in which Akhilesh Yadav was elected as president, was illegal and Ram Gopal Yadav had been expelled from the party before the convention.
When the Mulayam Singh Yadav along with Shivpal Yadav had released the list of party candidate for the assembly election in a press conference, the differences between Akhilesh Yadav and Mulayam Singh Yadav came into light on the candidate list and Akhilesh Yadav announced his own list for the upcoming assembly election.
The Akhilesh Yadav had called a meeting of party MLAs on 31st December, 2016 at his residence in the morning and claimed the support of 200 legislators out of 229 MLAs.
The next day Akhilesh Yadav elected as party's president in the national convention called by Ram Gopal Yadav of the party on 1 January, 2017.
The Akhilesh Yadav has claimed I am the president of the Samajwadi Party but Mulayam Singh Yadav said the convention is illegal and I am the party's president and according to Mulayam Singh Yadav, the party is united and all is well under the Mulayam Singh presidentship.
The Mulayam Singh said that there is some people behind the fued in the party, they wanted to destroy the future of Akhilesh Yadav. And the Akhilesh Yadav and Ram Gopal Yadav also claim the and named the Amar Singh behind the fued in the Samajwadi Party.
All though now the party is splitted into two factions, the one faction is Akhilesh Yadav supported by Ram Gopal Yadav and the second factions is Mulayam Singh Yadav supported by Shivpal Yadav, Amar Singh.
The war over the 'Cycle' symbol
As the party has splitted into two factions, the next was war over the 'Cycle' symbol, the war over the 'Cycle' reached to the Election Commission of India doorstep on 2nd January, when Mulayam Singh Yadav, Amar Singh, Jaya Parda and Shivpal Singh Yadav met the election commissioners Nasim Zaidi, O P Rawat and A K Joti.
Day after the Mulayam met Election Commission, the Ram Gopal Yadav of Akhilesh Yadav faction also submitted affidavit of 222 MLAs, who was supporting the Akhilesh faction.
The Mulayam Singh Yadav had said the EC that the January 1 national convention was illegal and the Ram Gopal Yadav has no right to call the party's national convention because he had expelled from the party before the convention and also said that I am the national president of the party.
The Election Commission hearing on 'Cycle' Symbol
The order on the dispute of 'Cycle' has been reserved by the Election Commission after the hearing arguments of both the factions on Friday. The election commission is expected to announce the interim order before the notification of UP assembly polls on 17th January 2017.
The senior counsels Rajeev Dhavan and Kapil Sibal represented the Akhilesh Yadav faction and the former solicitor general Mohan Parasaran and senior laywer RC Dhingra represented the Mulayam Singh Yadav faction.
As the they allowed to present their arguments first, Sibal and Dhawan cited the past precedent and the Symbols Order of 1968 to argue that since the numbers of supporters were stacked in favour of Akhilesh Yadav, the 'Cycle' symbol should go to him.
The Mulayam camp's Parasaran insisted there was not split in the party and, therefore there is not question of allocating the symbol to any one faction. The party is nuited, since no resolution was passed during the national convention called by the Akhilesh Yadav camp on 1st January, 2017 argued the former solicitor general, Mohan Parasaran.
The Mulayam camp also questioned the authenticity of the affidavits of the support from the party delegates and legislators submitted by Ram Gopal Yadav to Election Commission. The some of the affidavits are of deceased party members of the party and some members are in coma, Dhingra told the media persons.
The EC's notice announcing the hearing date, which was sent to both the factions, clearly states that the case, prima facie, is of a split in the party, Sibal pointed out.
Sibal also drwan the commission's attention to the fact that the Mulayam camp had not presented any evedence to support its claim that the party is united or to show that the majority of legislators and party delegates is behind the Mulayam Singh Yadav.
What will be the order of Election Commission?
The primary question before the EC is that whether there is a split in the party, after Mulayam Singh's lawyers had insisted that the Samajwadi Party is united, there is no split in the party.
If the EC decide that the party is not together then, as an interim measure, the Election Commission will freeze the 'Cycle' symbol and will ask the both factions to contest the upcoming assembly election under the different names and symbols.
