Eugene J. Maladys Clients Get Fresh Start From Filing Bankruptcy

Media, PA (PRWEB) June 12, 2015

Bankruptcy is a tool that can be used to help people facing everyday financial dilemmas, as in the recent bankruptcy case of a man who almost lost his small business, due to recent bad economic times (Case No. 12-13941, Eastern District of Pennsylvania). Attorney Eugene Malady, of Eugene J. Malady, LLC filed Chapter 11 for his client and was able to help save his clients business.

In this Chapter 11 case, the client owned a small business that suffered substantially due to the economic downturn. According to the court documents, he had approximately $ 750,000 in IRS tax debt. The law firm created a Chapter 11 plan for him that ultimately helped to save the business.

Eugene J. Malady, LLC, which specializes in bankruptcy and family law, among other areas of law, works with clients who are having financial hardships every day, helping to make a difference in their lives. Sometimes bankruptcy is the best way to go and can give someone the fresh start they may need to change their life for the better, said Malady. We help people save their homes, their businesses, even their relationships and give them a chance to start over.

Despite the fact that bankruptcies in America have lessened in the past few years, they are still a viable option. There has also been an uptick at the intersection between bankruptcy and family law matters where a separated spouse files a bankruptcy petition in order to attempt to affect the outcome of their family law case using the bankruptcy court. For example, Attorney Eugene J. Malady, recently represented the wife in an intervening motion in her husbands bankruptcy case in the Eastern District of Pennsylvania Bankruptcy Court (BK. No. 13-11408 MDC). According to the court documents, this case involved a post-marital agreement, in which the husband was required to pay the mortgage on the home and subsequently filed for bankruptcy in an attempt to get out of making the mortgage payments. Because he was not making the payments, the home was in danger of foreclosure. A single mother and her children faced the possibility of finding a new place to live.

Our firm stepped in to help the mother fight the father in his bankruptcy matter and the Court determined that his debt was nondischargeable, meaning he could not use bankruptcy to shirk his obligation, said Malady. By doing this, we were able to save a home for a single mother and her children.

Due to the increase in bankruptcy and family law cases, Malady, former Chairman of the Bankruptcy Committee and President of the Delaware County Bar Association, urges anyone facing such a case to seek legal service, in the event the other spouse files bankruptcy and tries to affect the outcome of a divorce.
