Understand the limits of copyright

For example, if you writing your own alternate history book based on actual historical events, it cannot be considered copyright infringement. However, if you writing a book based on another person’s work would be considered infringement, as facts and ideas created by a writer are considered original thought preserved by the law – unless, of course, the copyright has expire and the work has entered the public domain. You should always know the caution and investigate the copyright status of works you want to use.

Understand copyright exemptions

Always consider the exact purpose of the use, the extent of the use, how substantial it is, and the impact such use would have on the work’s market value. Avoid using the copyrighted work – or alternatively, ask for permission from the copyright holder.

Assume copyright until proven otherwise

Just start assuming that a given work is protected by federal copyright, unless you can reliably confirm that it is not because if you find that information on the Internet, then someone does already own it.

Very simple 2 rules:

  • Always stay away from fines or legal action which can take up valuable time and resources.
  • Identify and protect original works, and educate family and/or employees about copyright infringement.
