Success Stories: NIW Petition and Green Card Approved for CAE Durability (FEA) Engineer from Iran in the Field of Mechanical Engineering

Client’s Testimonial:

On September 1st, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a CAE Durability (FEA) Engineer in the Field of Mechanical Engineering (Approval Notice).

General Field: Mechanical Engineering

Position at the Time of Case Filing: CAE Durability (FEA) Engineer

Country of Origin: Iran

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Michigan

Approval Notice Date: September 1st, 2016

Processing Time: 8 months 14 days

Case Summary:

Exactly 8.5 months after North America Immigration Law Group (WeGreened.com) filed an EB-2 NIW (National Interest Waiver) petition for an Iranian engineer, Nebraska Service Center approved his case. Our client, a well-known professional working in the field of mechanical engineering, possessed suitable qualifications to secure the national interest waiver. Our job was to prove it to the USCIS. These are some of the key points we focused on:

  • We noted our client’s impressive publication and citation record. At the time of filing, these numbers stood at 13 and 76 respectively.
  • Our client’s petition also contained six recommendation letters contributed by his peers. Ranging from a senior lecturer to a research engineer, our client’s prominent peers firmly supported his petition by signing off on statements such as this one: “I believe you would be hard -pressed to find another researcher with the combination of expertise and experience [Client] offers, and I think his continued work in the United States would be good for the field and good for your country. I hope that my letter has been useful to you as you consider [Client’s] request.”
  • To prove that our client deserved to have his petition approved, we carefully accounted for his research on the analysis of material failure and reliability for the energy and power generation industry and the automotive industry as well as for structural applications. We demonstrated that his findings have directly contributed to the American energy sector, to the automobile industry, and to ensuring the integrity of various infrastructure components. We concluded that our client’s material failure and reliability research efforts strengthen and ensure the safety of the energy industry in the United States.

Filing the I-485 while the I-140 is pending approval:

Nearly a month and a half after our client received notification of EB-2 NIW approval, the USCIS approved his I-485 application. As this is the final step in the green card process, this approval meant that our client had successfully become an American permanent resident. The reason why he only waited a month and a half for the USCIS to approve his I-485 application is because he chose to file it while his EB-2 NIW petition was pending approval. This gave the USCIS a head start on his application. We congratulate him for securing permanent residence and we wish him well as he continues to progress the field of mechanical engineering in the United States.
