Robert Way — a postdoctoral fellow in physical geography who grew up on the Churchill River riverbank and now works out of Memorial University’s Labrador Institute — says he doesn’t believe the people behind the study were given enough data to rule out Muskrat Falls as a contributing factor.

“The current state of monitoring [on the river] is actually quite poor,” he said.

In their preliminary findings, researchers attributed the May flood to heavy November rains and a quick spring thaw.

Way says the biggest contributor was an ice jam that backed up five to six feet of water into Mud Lake.

“They didn’t have the data to be able to look at the ice jam and whether that was related to anything upstream at Muskrat Falls or Churchill Falls,” he said.

“And the reason they didn’t have the type of data that was needed was because it wasn’t being collected.”

According to Way, ice thickness data is collected once a year, around March, from six testing sites that go in a line across the river near the Mud Lake crossing — not the year-round, real-time monitoring Way said Nalcor committed to.

“These measurements would have shown that the ice thicknesses along that section, at the mouth of the river, were anomalously thick last winter,” he said.

“If [researchers] were using this information to try and inform the likelihood of ice jamming occurring, it would have been a really high chance of it occurring, because when the ice gets really thick, it has a higher potential to jam and it’s harder to push away.”

Researchers explained Thursday that they would be looking to get an expedited copy of ice thickness data, usually released in October, in order to include it in the final report due later this month.

Indigenous knowledge not thoughtfully included

Way also takes issue with the lack of traditional knowledge incorporated into the research, saying it wasn’t included to the degree expected from the residents or as part of the research application.

Chunks of data were missing on the timeline of events, in addition to not having information on the ice thickness variable.

Way suggested those gaps could and should have been filled with local knowledge.

“Your baseline should be that if you have people who have been in the area — and their families, for over 100 years —and that they noticed unusual things, that this should form the basis for some of your understanding of what happened,” he said.

“From [the researchers’] perspective, I think they presented only, really, information from what happened climate-wise and the water levels, and then casually mentioned, 'Oh, people said it was high,’ things like that.”

  • We have been making three reasonable requests that to date have been met with unreasonable government responses that extend from completely being ignored by our elected representatives to an increased police presence consisting of hundreds of RCMP from a "Criminal Intelligence Unit”
  • We have supporters throughout the province, country, and around the world who are asking for the same requests to be honoured. Our three requests to NL Government are:
  • 1. Immediate progress on the methyl mercury agreement signed Oct 2016 by Labrador Indigenous leaders and the NL Government
  • 2. Initiate an independent review of the North Spur, a sensitive area of land that could lead to catastrophic failure and loss of life downstream.
  • 3. Order a public inquiry including a forensic audit of Nalcor now before the project is completed and too much damage is already done.Until these requests are met with the satisfaction of the people downstream, we’ve been left with no other choice than to declare this project is not safe or in any way beneficial to us downstream. With our lives on the line and no free, prior, and informed consent from Labrador people, we must demand the Muskrat Falls hydro project be shut down!
  • Our “Shut Muskrat Down” campaign is built on three streams of reason:
  • 1. Environment - Destroying huge tracts of habitat, sensitive wetlands, preventing nutrients from reaching the ocean system, and building a reservoir that will contribute GHG into the atmosphere and methyl mercury into the food web downstream.
  • 2. Human Rights: Putting the downstream population at risk of poisoning and flooding, using the justice system and law enforcement against peaceful protectors, putting intense strain on the health and well-being of all involved, using government legislation to silence people and create secrecy of project details, and continued colonial oppression of the Labrador people
  • 3. Economics: Federal Government role in issuing permits and loan guarantees which have put tremendous strain on the finances of the Newfoundland and Labrador population, provincial government via their crown corporation Nalcor to force people of the province to pay for an unnecessary and over-budget project, loss of property value to downstream area, increased cost of living downstream from boom and bust cycle creation, and potential risk of infrastructure collapse to municipalities if the dam collapses.
  • To further explain why we are fighting against Muskrat Falls:
  • 1. Inuit and Southern Inuit/Metis were never consulted to give free, prior, and informed consent to this project. This projects affects the waterways and lands around Inuit Settlement Areas. That we were not consulted directly violates the United Nations Declaration on the Rights of Indigenous Peoples (Article 28)
  • 2. This project has been fraught with racism from the very beginning . Innu workers at Muskrat Falls worksite have faced everything from racist remarks to physical assault on the job. 
  • This is unacceptable.
  • 3. The Muskrat Falls dam will cause significant methyl mercury contamination. Methyl mercury is a neurotoxin that bioaccumulates in fat as it progresses up the food web. This is particularly harmful to us because we hunt and fish from these waters. By contaminating the food sources of our traditional diet, Nalcor is cutting us off from our culture and way of life.
  • 4. The dam itself is built on quick clay (North Spur) and poses a serious safety risk to the public. Experts have spoken out against the structural problems that arise from building on quick clay and have deemed it “not safe”. Furthermore, Nalcor is passing the buck on their inadequate emergency response plans in case of a breach in the dam.
  • 5. The economic impacts of this project will haunt our province forever. Nalcor’s own CEO called the project a boondoggle ! The estimated costs are up to $11.4 Billion , and rising. This will impact the entire province, not just Labradorians.
  • These are just a sampling of the serious issues that we are fighting against. And the only reasonable solution: Shut. Muskrat. Down.
  • We have been on the ground fighting this project for years. However, our actions have ramped up in the last few months. As a result, Nalcor is doing everything they can to silence us. Here is a brief timeline of recent legal actions taken against us:
  • October 17th, 2016: Nine land protectors are arrested in an overnight raid, including the violent arrest of a young inuk woman.
  • October 22nd, 2016: Land protectors begin their five-day occupation of the Muskrat Falls work camp.
  • October 24th, 2016: A court order threatens 22 land protectors with arrest for occupying the camp and for continued on the ground action at the main gates of Muskrat Falls. This includes journalist Justin Brake of who was on the scene covering events for The Independent, a move that is highly criticized by many journalism organizations .
  • November 22nd, 2016: Ten more land protectors are arrested in ambush-style arrests. Another injunction is issued naming a further 15 land protectors, including a 96 year-old elder who visited the gates to get her picture taken, and a photojournalist who was simply documenting events.
  • Since then more arrests have occurred including Inuk grandmother Beatrice Hunter and Inuit Elders James G Learning, Eldred Davis, and Marjorie Flowers. All four were kept for over a week in a maximum security prison in St. John’s which is hundreds of kilometers away from their homeland. They were all released on conditions that see two of them on house arrest and the others restricted from peaceful protest within 1km of the work site except for a small parking lot area known as the “protest pad”.Many other land protectors have been forced to sign similar undertakings and the list of those charged continues to grow and we take further action to protect our land, water, and lives from the destructive mega-dam.
  • Given the sheer volume of land protectors who have been arrested or face possible arrest, we are raising funds to support our legal fees.Our goal is to assemble a legal team that will help us fight Nalcor’s unconstitutional injunction, the many charges our members are facing both criminal and civil, and the overall project that has changed in so many ways since it first began that we believe the Duty to Consult must take place again.in our many many court appearances.
